Questions being raised on functioning of Jpr Div Commissioner

Jaipur: A decision of the Jaipur Divisional Commissioner regarding a resort land in Jamwaramgarh has come under question and a complaint with detailed facts has been filed with the CMO and the Chief Secretary.

The matter is related to a 15-bigha land (Khasra No. 83/182, 83/183 and 83/184) in Anoppura village in Jamwaramgarh. Conversion of the khatedari land was done under rules by the then Jaipur District Collector in 2011 for a resort. This rule-based conversion order was hastily cancelled by the court of Jaipur Divisional commissioner Arushi Malik and directions were given to register the khatedari land as Siway Chak (govt land) land.

A section of lawyers has found the order strange saying that even if the conversion of the said land was to be cancelled, the land could not be mutated as Siway Chak (govt land).

The Divisional Commissioner court gave the order on August 13. The appellant was strangely given a relaxation in time limit for filing the appeal after 13 years. The notices to the resort owner were sent at the old address and no party found there, even then the notices were considered properly served and a decision in a 13-yearold land conversion case was given without giving the resort owner an opportunity of proper hearing.

The decision cited violation of FEMA, lack of an approach road and falling within the ESZ (Ecological Sensitive Zone) whereas Anoppura village is outside ESZ, approach road is also present since years and there is no document on record of any violation of FEMA.

Moreover, no report was taken from the forest department. Also, there is no complaint in this regard from the forest department. The hurry was such that on a holiday, during the sick leave of the Tehsildar, the charge was given to the Naib Tehsildar and strict instructions were given to register the land as Siway Chak (govt land).

The affected party, Aditya Baheti, Director of Dar Karmous Resorts Private Limited, complained to the Chief Secretary with detailed facts of the entire case. He also sent his complaint to the Chief Minister’s office.

According to the sources, after this the ID of the Tehsildar Jamwaramgarh was blocked following directions from the high level so that the process of transfer of land remains stopped in compliance of such a controversial decision. Now, the affected party is preparing to go to the ACB and the High Court. The Divisional Commissioner is not ready to comment on the matter. The officers of the district administration are also silent over the matter. First India has the copy of the Divisional Commissioner’s order and the copy of the complaint made against her. Now, the Chief Secretary or the Chief Minister’s office will have to get this matter investigated.
